1.0 Design, including Online and Print Media

All content created by Etharius Ltd will remain the property of Etharius Ltd until the goods are paid for in full.

Any digital media that is not paid for in full may be taken offline at any time. Etharius Ltd reserves the right to pursue clients for any payments outstanding against finished work at any time.

1.1 Copyright

The copyright of any design/images/text used on any site created by Etharius Ltd is owned by the client. This does not apply to any Etharius Ltd products such as:

• eCommerce Console
• Content Management Console
• MailShot Console
• Any other Etharius Ltd code

ALL code used within the website is the copyrighted property of Etharius Ltd. The client may modify or adjust this code for use only on the domain the product was designed for. The client may not:

• Reproduce code owned by Etharius Ltd
• Resell code produced by Etharius Ltd
• Give copies in whole or in part to any third party

Any violation of the above will be considered an act of theft and pursued accordingly.

2.0 Hosting

Etharius Ltd hosts websites within the UK, and as such is subject to UK laws governing content.

2.1 Files and Websites

Etharius Ltd reserves the right to remove any files that infringe UK law, including copyrighted materials distributed without permission.

In such instances records/files may be passed on to officials or the police without any notice given to the client.

2.1.1 Removing services

Etharius Ltd also reserves the right to shut down any website/email services being used to carry out illegal activity without notice or consent of the client.

2.2 Email

Etharius Ltd reserves the right to access any account on its network for reasons of:

i. Legitimate maintenance, for example to retrieve information that is required to maintain our services

ii. Suspicion of illegal activity, including communications regarding criminal acts or the use of our servers to send spam.

In such cases, Etharius Ltd reserves the right to take copies of such files for use in criminal investigations.

2.3 Quality of Service

Etharius Ltd takes great care to ensure the quality of its servers/software and maintains all systems on its network to guarantee maximum uptime for its clients.

Etharius Ltd owns all of the hardware and software used in providing hosting services, and no third parties are involved.

Our servers are located in London on a T1 pipeline by Rapidswitch Ltd.

All scheduled maintenance undertaken by Etharius Ltd takes place after 20:00 GMT and, in the event that downtime is likely for more than 5 minutes, will notify clients by email.

Etharius Ltd cannot be held responsible for downtime to its services caused by:

• Maintenance undertaken by our hosting centre
• Failures on the connecting pipeline
• Attacks/Hacking attempts on specific websites where third party code is responsible
• Acts of God, including Fire/Natural events.

3.0 Agreements

All clients agree to abide by these terms and conditions when using Etharius Ltd for provision of services.

Any infringements of these terms and conditions will be dealt with at the discretion of Etharius Ltd.
